Acceptance of Terms

MinimaDesk (“the provider”) offers software and online services to you under the following terms (“Terms of Service”). If you do not agree to these terms, you must not use the MinimaDesk.com website.

Product License

The products offered on MinimaDesk.com are licensed under the General Public License (GPL). All items in the MinimaDesk directory are developed by third-party developers and redistributed by MinimaDesk. MinimaDesk is not affiliated with the developers of any of the items displayed on this site and does not provide additional services such as author support or license keys.

Product Support

We provide support for any issues related to direct experience with us (such as download issues, navigation problems, or any issue related to our site or our operations). You can contact us through the contact form or by email at contact@MinimaDesk.com.

We do not offer support for issues related to the product author, such as customizations, licensing problems, version failures, or other developer-related issues.

Third-party products are supported by their authors, not MinimaDesk. Please review the support terms provided by the author before purchasing the product.

Product Updates

Once we are notified about a product update (via user or author notifications), we download the product, check for issues, and verify if it requires prior activation. We then pre-activate and post it on our website.

The product release date varies based on the circumstances, such as the author, the contract, and the activation requirements, among others.

All individual purchases include lifetime updates. If you purchased a membership, you will be able to access updates and content as long as the membership remains active.

Lifetime update service will only be valid as long as there is an active contract or membership with the product developer or distributor. In most cases, contracts are renewed and usually unaffected, but if the supplier or promoter decides not to renew the contract unilaterally or if we face any issue with the promoter, we will not be obligated to continue providing the latest version of the products.

Product Pricing

We do not guarantee that any particular product will be available on our site. We reserve the right to modify or suspend all or part of the downloads at any time, with or without prior notice. Furthermore, we may add new downloads with or without notice. Prices for any product may change at any time by publishing the changes on our website. However, the prices set starting April 26, 2023, for all individual purchases are $4.95 USD.

Memberships

“Public Membership” prices for 2024 are as follows:

  • Monthly Membership: $9.95 USD
  • Annual Membership: $59.95 USD
  • Lifetime Membership: $99.95 USD

Please note: If needed, we can migrate your account to a premium lifetime membership.

Customer Accounts

Customers must create an account when purchasing any product. They are responsible for maintaining the confidentiality of their password and are not allowed to share or distribute their account login details. Customers are fully responsible for all activities that occur under their accounts and agree to notify the provider immediately about any unauthorized use of their accounts or any other security breach.

The provider will not be liable for any loss or damage arising from a breach of these terms by the customer. Please note that the provider requires all users to be over 18 years old to create a customer account. If you create an account, we assume that you are over 18 years old.

Account Cancellation and Suspension

The provider reserves the right to suspend and/or terminate any user account without notice at its sole discretion. No refunds will be provided to customers whose accounts have been terminated.

Examples of reasons for termination include:

  • Abusive behavior and/or excessive negativity toward staff.
  • Repeated defamatory, malicious, and/or false statements including slander against the provider and/or attempts to dissuade potential customers from purchasing the provider’s products.
  • Misuse of server services, technical abuse of resources, or any type of malicious practices that threaten MinimaDesk services and/or equipment.
  • If the provider reasonably believes that your account has been compromised or shared with others for other security reasons.
  • Sharing, transferring, or reselling the user account. Accounts are non-transferable.

Product Delivery

After payment from the customer, account login details will be sent to the email address provided during registration. This may take up to 30 minutes after purchase, but usually occurs between 1 to 15 minutes. Download access is typically provided immediately after payment verification.

Refunds

Due to the nature of the service, we do not offer refunds, except in the following case:

  • Issues with downloading a product during a regular purchase (which cannot be resolved by our team within 24-48 hours after payment verification or user notification).

We will not offer a refund if the product does not meet your expectations or needs, as this is the customer’s responsibility. To avoid such issues, all products contain links to the author’s details.

Memberships are not eligible for refund services.

Business Use of Our Products and Services

If you use our services on behalf of a company, the company accepts these terms. The company will protect the provider and its affiliates and employees from any claims or lawsuits arising from or related to the use of the product or service, or violations of these terms, including any liability or expenses arising from claims, losses, damages, or legal matters.

Warranty

Except as expressly stated in these terms or any additional terms, the provider or its suppliers or distributors make no specific promises regarding its products or services. For example, the provider makes no representations about the content, functionality, reliability, availability, or ability of products and services to meet your needs. We provide the products and services “as is.”

Liability for Our Products and Services

To the extent permitted by law, the provider, its suppliers, and distributors will not be liable for lost profits, revenue, data, financial losses, or any indirect, special, consequential, exemplary, or punitive damages.

To the extent permitted by law, the provider’s total liability and that of its suppliers and distributors for any claim under these terms, including any implied warranties, will be limited to the amount you paid the provider for the use of its products or services.

Miscellaneous

  • Updates to Terms of Service: The terms of service may be updated from time to time but will not be applied retroactively. A notice of changes to the terms will be posted on this page, and they will become effective 10 days after posting. Changes may be made due to new functionalities or to comply with legal changes or urgent legal reasons immediately.

  • Waiver or Non-enforcement: If you fail to comply with these terms and the provider does not take immediate action, it does not mean that the provider waives or abandons any rights, such as the right to take action in the future.

  • Severability: If any provision of these terms of service is found to be unenforceable, it will not affect the other provisions.
